Colorado DMV Points System
Colorado employs a points system that automatically suspends a driver’s license in the event that they accumulate the following points within a given time frame:
- Drivers 17 and under:
- 6 or more within any 12 months
- 7 or more at any point while under the age of 18
- Drivers 17 to 21:
- 9 or more within any 12 months
- 12 or more within any 24 months
- 14 or more at any point between ages 18-21
- Drivers over 21
- 12 or more within any 12 months
- 18 or more within any 24 months
Points are awarded based on the severity of the offense (likelihood that it will cause harm to the driver or other road users). Examples include:
- Failure to yield right of way: 3 points
- Failure to yield to emergency vehicle: 4 points
- Careless driving: 4 points
- Improper lane passing: 4 points
- Running a stop sign/ traffic light: 4 points
- Reckless driving: 8 points
- DWAI: 8 points
- Causing serious bodily injury to a vulnerable road user: 12 points
- Hit and run: 12 points
- Evading a police officer: 12 points
- DUI: 12 points
- Speeding:
- Five to nine miles per hour over the speed limit = 1 point
- 10 to 19 miles per hour over the speed limit = 1 to 4 points
- 20 to 39 miles per hour over the speed limit = 6 points
- 40 miles per hour or more over the speed limit = 12 points
How Long Can My License Be Suspended?
Even a small to moderate infraction can be the straw that breaks the camel’s back, resulting in a suspended license if a driver incurs 12 points on their license within a year, or 18 points within two years.
Upon accruing enough points for a license to be suspended, you will attend a motor vehicle hearing, at which point a hearing officer will determine the length of your suspension. The maximum suspension is 12 months, and the officer will take your driving history and violations into account when determining the length of the suspension. It is advisable to work with an attorney throughout this hearing process.
